Sub Judge/Special Mobile Magistrate Jammu Directs SHO Gandhi Nagar to Register FIR on Bhupender’s Complaint Under Section 175(3) BNSS

Jammu, January 29, 2026:
In a significant order reinforcing judicial oversight over police inaction, the Court of Sub Judge/Special Mobile Magistrate, Jammu, presided over by Sh. Slahuddin Ahmed, on Tuesday directed the Station House Officer (SHO), Police Station Gandhi Nagar, to register an FIR and conduct investigation on a complaint filed by Bhupender under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

The directions were passed in Case No. Complaint/1596/2025 (CNR No. JKUD030088802025), instituted on August 11, 2025. The applicant/complainant Bhupender, son of Bhim Singh, originally a resident of Aajad Nagar, Panipat (Haryana) and presently residing at Nanak Nagar, Gandhi Nagar, Jammu, had approached the court through his counsel Sh. V.S. Thakur, Advocate, seeking judicial intervention against alleged police inaction.

After perusal of the complaint and accompanying material, the court observed that the allegations disclosed commission of cognizable offences, thereby necessitating police action. Exercising powers under Section 175(3) BNSS, the court directed the concerned SHO to formally register a case and proceed with investigation strictly in accordance with law.

The court further emphasized that the purpose of Section 175(3) is to ensure that genuine grievances of citizens are not ignored and that the police machinery remains accountable. The SHO Gandhi Nagar has been instructed to take immediate necessary steps and submit a compliance/status report before the court within the stipulated time.

The order, dated 27.01.2026, is being viewed as an important step toward strengthening access to justice and reaffirming the supervisory role of courts in ensuring prompt and fair investigation of complaints.
