Kishtwar, August 21, 2026: Police have registered a case and arrested two persons, including a government school headmaster and his brother, in connection with the death of a minor girl under suspicious circumstances in the Chatroo area of Kishtwar district.
The incident has triggered widespread condemnation and mass protests in the Chatroo area. Protests have reportedly continued since overnight, with people taking to the streets to condemn the alleged sexual assault of the minor and the circumstances surrounding her death. A complete shutdown is being observed across the area, with shops and other business establishments remaining closed in response to the incident.
According to the FIR N0 34/2026 registered at Police Station Chatroo, the case was initiated after police received information regarding the suspicious death of the minor. The deceased was taken to District Hospital Kishtwar, where medico-legal proceedings, including post-mortem examination and collection of DNA samples, were conducted.
The FIR names Khalid Hussain, son of Ghulam Mohammad, resident of Gorinall, Chatroo, and Tariq Hussain, son of Ghulam Mohammad, resident of Gorinall, as accused. Khalid Hussain has been described as the headmaster of a government middle school in the area.
As per the allegations contained in the FIR, the minor, who was a student at the school, was allegedly subjected to repeated sexual assault by the headmaster, resulting in her pregnancy.
The FIR further alleges that attempts were subsequently made to suppress the matter and that money was offered to the family. It also alleges that, allegedly in conspiracy with his brother, the minor was administered medication intended to terminate the pregnancy.
According to the police case, the minor subsequently died, while the newborn child was also delivered in a dead condition. Police collected biological samples and other material evidence during the medico-legal proceedings.
The case has been registered under Sections 61(2), 65(1), 90, 91 and 92 of the Bharatiya Nyaya Sanhita (BNS), 2023, besides Sections 4, 6, 8, 10 and 17 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.
Legal provisions invoked
Section 61(2) BNS deals with criminal conspiracy in relation to specified serious offences.
Section 65(1) BNS provides enhanced punishment for rape of a woman below 16 years of age.
Section 90 BNS deals with causing the death of a woman by an act intended to cause miscarriage, including circumstances where the act is performed without her consent.
Sections 91 and 92 BNS deal with acts intended to prevent a child from being born alive or causing the death of a child after birth, and causing the death of a quick unborn child through an act amounting to culpable homicide, respectively.
The POCSO Act provisions invoked include Section 4 concerning penetrative sexual assault, Section 6 concerning aggravated penetrative sexual assault, Sections 8 and 10 concerning sexual assault and aggravated sexual assault, and Section 17 concerning punishment for abetment of a POCSO offence.
Police have arrested both accused persons, and further investigation into the case is underway.
The incident has sparked strong public anger in Chatroo, with residents and protesters demanding strict action against those found responsible and justice for the deceased minor.
