In a significant step, the Home Department of Jammu and Kashmir has amended the Union Territory’s Prison Manual–2022 to address the specific needs of prisoners with disabilities.
According to the official notification, the amendments aim to enhance the treatment, care, and overall welfare of inmates with disabilities.
These amendments were incorporated into the prison manual following directions from the Lieutenant Governor of Jammu and Kashmir to the UT’s Home Department.
According to the official notification, prisoners with disabilities must not face any discrimination on the basis of their condition and are entitled to equality, dignity, and respect.
“No prisoner shall be discriminated against on grounds of disability. All prisoners with disabilities shall be entitled to equality, dignity, and respect for their integrity on an equal basis with others,” the notification reads.
It further mandates that all prison infrastructure must be made accessible in line with the Accessibility Standards and Guidelines issued by the Ministry of Home Affairs (MHA).
“Prisoners with disabilities should be provided appropriate healthcare services, including psychiatric and psychological support, as well as access to rehabilitation programmes and therapies,” it states.
The amended manual also stipulates that all incoming inmates must be screened for disabilities at the time of admission.
“Relevant prison records should reflect their specific needs to ensure proper accommodations and assistance,” the notification adds.
Additionally, it emphasizes that prison staff must receive regular training to sensitize them to the requirements of prisoners with disabilities and to ensure appropriate handling. (Agencies)
